General conditions of sale and purchase of non-personalised products online and use of the website
Article 1. Scope of application
The present general conditions apply to the purchase of non-personalized products, without the intention of reselling them by non-professional buyers made in France on the website of cuisse de grenouille.
Customised products are products presented in the "made-to-measure" category and produced according to the specifications of each customer who orders them and are not governed by these general terms of sale.
Article 2. Ordering and buying on our website
2.1 Eligibility to order and purchase
In order to place an order on our website, you must have the legal capacity to do so and not purchase a product with the intention of reselling it
2.2 How to order
Nothing could be easier!
- Visit our e-shop and find the products you want to wear.
- Add the products to your shopping cart by clicking on the "Add to cart" button.
- Once you have finished your selection, place the mouse cursor on the basket and check its contents. Confirm by clicking on the "Checkout" button.
- If you already have an account in our e-shop, please log in using your e-mail address and password in the "Already registered?
- If you do not have an account in our e-shop yet, you can create one easily and quickly. Enter your email address in the "Create your account" section and click on the "Create your account" button. Fill in the detailed fields, create your password and confirm the creation of your account by clicking on the "Register" button. An e-mail will then be automatically sent to you, reminding you of the information required for your next connection (e-mail address and password)
- Check your order.
- Check your delivery and billing addresses carefully
- Choose a delivery method. For more information please refer to article 5 and following
- Choose your payment method and proceed with the payment. For more information please refer to article 3 and following
Your order becomes final, as it appears on the screen, from the moment you validate it at the end of the ordering process.
Once the payment is done, a confirmation of your order and your payment will be sent to you by e-mail. Cuisse de Grenouille advises you to keep it, it can be useful later.
Please note that your order becomes final and binding from the moment you pay for it.
2.3 Refusal of an order or cancellation of a purchase.
Cuisse de Grenouille reserves the right to refuse an order on just cause.
Cuisse de Grenouille also reserves the right to cancel a purchase (accepted order) for good reason.
Refusal of an order or cancellation of a purchase for good cause shall not give rise to any compensation, but to reimbursement of the price of the products if this has been paid.
Reasonable grounds include: product not available in stock (you can wait for restocking or get a refund); incorrect or unverifiable bank details; order identified as unusual or susceptible to fraud; payment not received by bank transfer or cheque within 8 calendar days of acceptance of your order; we have reason to believe that your purchase is for resale; the selling price quoted on the website contained an error; the address you provided does not fall within the geographical scope of delivery
2.4 Data control
Cuisse de Grenouille reserves the right to check the personal and banking data that you provide when creating your account or ordering.
Article 3. Price/Payment
3.1 Payment methods
PAYMENT BY CREDIT CARD :
For this type of transaction Cuisse de Grenouille works in partnership with La Bred Banque Populaire and Paypal.
3.2 RESERVATION OF OWNERSHIP
Cuisse de Grenouille retains ownership of its products until full payment of the price of its products has been received.
3.3 Prices and currency
Prices are quoted inclusive of Value Added Tax (VAT).
Shipping costs are not included in the prices indicated on the products. Shipping costs depend on the delivery method chosen and the place of delivery. The shipping costs must be added to the prices of the products to calculate the total amount to be paid.
3.5 Breakdown of the total price
The total price to be paid is the sum of the price of each product in the basket and the shipping costs. It is indicated at the last stage of the payment procedure.
3.6 Price changes
Cuisse de Grenouille reserves the right to modify the price of the products indicated on its Internet site. The prices appearing at the time of the validation of the order are the prices applicable to this purchase.
3.7 Pricing errors
In case of obvious error on the price of a product, Cuisse de Grenouille is not bound by its offer and will give you the possibility to cancel your order or to confirm it at the real price of the product which will be communicated to you by Cuisse de Grenouille.
Article 4. Security of transactions
Cuisse de Grenouille uses a SSL (Secure Socket Layer) protocol for the security of transactions. It is currently one of the most effective encryption protocols. Your banking information is encrypted throughout the payment process and is not stored on a public server.
Despite all our efforts to secure payments, there is always a small risk of fraud. Cuisse de Grenouille cannot be held responsible for damages resulting from the use of electronic means of communication and payment.
Article 5. Shipping and delivery
5.1 Delivery
We deliver the products worldwide.
We deliver from Monday to Friday. Orders placed on Saturdays, Sundays and public holidays are shipped the following Monday.
In the event that the delivery address you have given us proves to be inaccurate or in the event that the delivery service is unable to deliver your parcel for reasons for which you are responsible, you will be responsible for the costs of returning the parcel to us.
5.2 Method and time of delivery
Cuisse de Grenouille proposes three types of deliveries. The deadlines run from the reception by Cuisse de grenouille of the complete payment of the price:
Standard Delivery (48 to 72 hours on working days)
It is sent by Colissimo France without a signature at the postal rate in force on the date of the order. See the Colissimo rates.
Express delivery (24 hours on working days)
For all orders placed before 12 noon. It is carried out by TNT at the rate in force on the date of the order. See TNT rates.
If the delivery deadline is exceeded by more than 7 days and not due to force majeure, you can cancel your order by registered letter with acknowledgement of receipt. You will then be reimbursed within a maximum of 30 days.
5.3 Split delivery
Cuisse de Grenouille tries as much as possible to deliver all the products of your order at once and as soon as possible. However, Cuisse de Grenouille reserves the right to deliver the products of your order in a staggered manner in cases where for reasons of logistics or availability of products in stock a delivery at once would be impossible. In such a case you will be informed by mail and no additional shipping costs will be charged.
Article 6. Shipping costs
6.1 Shipping costs
Shipping costs depend on the type of delivery chosen. They are free in France for orders over €150.
When you order, this amount is indicated when you choose the delivery method.
Article 7. Returns and cancellations
7.1 Returning defective products after delivery
You have the right to return delivered products if they are defective or do not conform to your order.
Upon receipt of the returned products and after inspection, we will refund you within 15 days.
Cuisse de Grenouille undertakes to respect its legal obligations as set out in the following articles from the Consumer Code and the Civil Code:
CONSUMER CODE - ARTICLE L211-4
"The seller is obliged to deliver a good in conformity with the contract and is liable for any lack of conformity existing at the time of delivery. He shall also be liable for any lack of conformity resulting from the packaging, the assembly instructions or the installation when the latter was made his responsibility by the contract or was carried out under his responsibility. Consumer Code - article L211-5
To be in conformity with the contract, the goods must :
- be fit for the purpose ordinarily expected of similar goods and, where applicable : - correspond to the description given by the seller and possess the qualities that the seller has presented to the buyer in the form of a sample or model: - have the qualities that a buyer may legitimately expect in view of the public statements made by the seller, the producer or his representative, particularly in advertising or labelling.
- or have the characteristics defined by mutual agreement between the parties or be suitable for any special use sought by the buyer, brought to the attention of the seller and accepted by the latter. Code de la Consommation - article L211-12 The action resulting from the lack of conformity is prescribed by two years from the delivery of the goods. Civil Code - article 1641
The seller is bound by the guarantee for hidden defects in the item sold which render it unfit for the purpose for which it was intended, or which so diminish this use that the buyer would not have acquired it, or would only have paid a lower price for it, if he had known about them. Civil Code - article 1648
The action resulting from redhibitory defects must be brought by the purchaser within two years of the discovery of the defect.
7.2 Returning products after delivery without reason - Right of withdrawal
If you are not satisfied with the products ordered, you can exercise your right of withdrawal and return them to us free of charge (from France) within 14 days of the postmark.
The exercise of the right of withdrawal is materialized by the return of the products and is dated from the day of sending of the returned products.
As soon as we receive the products, we will refund the price of the products, excluding shipping costs, within a maximum of 30 days or we will offer you a credit note which you are free to refuse.
However, the return will be refused and no refund will be given in the following cases:
- labels and blisters (plastic sleeve) were removed and not included in the return
- the products have been washed, used or worn except for a simple fitting
- the product is not complete. If your order includes different products that are not linked together (non-exhaustive examples of linked products: pair, inseparable set, etc.) you can return only part of your order. Only the returned products will be refunded.
- The products have been modified or denatured
How do I return from abroad?
International returns are at the customer's expense. We will not be able to provide you with a return label, nor will we be able to pay for any customs fees that may apply when your return package is picked up.
You have 45 days to return an item. We accept returns only if the label is still on the product and it has never been worn for more than a fitting.

Article 8. Information on reimbursement
The cost of returning defective products or products that do not conform to your order will be fully reimbursed (shipping and return costs).
Article 9. Pre-orders
Pre-ordering allows you to reserve a product before its release by Cuisse de Grenouille and to be among the first to enjoy a new Cuisse de Grenouille product. The pre-order is not yet available on Cuisse de Grenouille. We are doing our best to offer it to you very quickly.
Article 10. Promotional codes (discounts)
10.1
A promotional code entitles you to a one-off discount on the purchase of one or more products in accordance with the conditions set out in the promotional code.
10.2
Promotional codes are personal. Promotional codes are inalienable and may not be sold, bartered, exchanged or made available to the public free of charge or for a fee on an Internet site or any other communication medium without the prior express written consent of Cuisse de Grenouille.

Promotional codes issued by Cuisse de Grenouille can only be used on the website www.cuissedegrenouille.com

You can only use one promotional code per product.
10.5
Promotional codes cannot be combined with other promotions.

Promotional codes are not redeemable for cash.

Promotional codes are not refundable.

Cuisse de Grenouille reserves the right to cancel a promotional code if it is not used in accordance with the above.
Article 11. Availability
If, despite the care we take in managing our stocks, an order has been validated while the product(s) ordered is (are) not available in stock, Cuisse de Grenouille reserves the right to offer you other products in replacement or to cancel the order.
In case of cancellation of your order you will have the choice between a refund or a credit note.
Article 12. Validity of offers
Our offers are valid for as long as they are visible on our website or between the dates indicated in the case of a fixed-term commercial operation.
In the event of an obvious error in the offer, Cuisse de Grenouille is not bound by its offer and will give you the opportunity to cancel your order or to confirm it under the actual conditions of the offer.
Article 13. Liability
Cuisse de Grenouille is only liable for breach of its contractual obligations under the terms of the applicable legislation.
Cuisse de Grenouille cannot be held liable for any damage suffered by a third party resulting from the use of one of our products.
Cuisse de Grenouille cannot be held responsible for any damage resulting from the misuse of one of our products by you.
Cuisse de Grenouille is not responsible for damages resulting from erroneous information on its websites.
Article 14. User Generated Content
14.1
Any content added to the site www.cuissedegrenouille.com by users of the site (opinions, ideas, comments, votes, articles, photographs, films, drawings, creations, etc.) and made public on the site becomes the property of Cuisse de Grenouille.
Cuisse de Grenouille reserves the right to use, publish or not the content added by the users and in any way whatsoever.
Article 15. Law in force
These terms and conditions, as well as any disputes which may arise from them, or which result from the use of the website(s) or purchases made on the Cuisse de Grenouille websites, are governed by French law.

Cuisse de Grenouille is not responsible for the use or the content of the linked websites.
Cuisse de Grenouille is not responsible for the use or the contents of the Internet sites which provide a link towards the site of Cuisse de grenouille.
Article 18. Intellectual property rights
Cuisse de Grenouille is the owner of the brand names, names, denominations, product titles, designs, models, photographs mentioned on the site www.cuissedegrenouille.com which are either registered trademarks or trademarks, or designs, models, works subject to an intellectual property right.

In accordance with the provisions of the law of 78-17 of January 6, 1978, modified in 2004, this website has been declared to the Commission Nationale Informatique et Liberté (CNIL) under number 1450383.
